    In the name of God, Amen.

    I, PETER DuBOSE, of the County of Dallas and State of Alabama, do hereby make and declare this my last will and testament, revoking any and all others I may have heretofore made.

    In the first place, I devise and bequeath to my beloved wife, MARY DuBOSE, to her and her heirs forever, those two lots of land numbered 2 and 3 in Section 16, Township 17, Range 12, and also the cotton now growing thereon, as also all the stock of horses, cattle, oxen, hogs, sheep and all household and kitchen furniture and farming utensils on said plantation and also the Negro slaves ALFRED, CLARA, NELSON and LEAH, to hold the said slaves during her natural life and after her death to descend to my children in equal proportion.

    I give and bequeath to my daughter CATHERINE the Negro man JACK and woman JANE and a bed and furniture, to her and her heirs forever, to be at once subject to her control.

    I bequeath all the residue of my personal estate not hereinbefore willed to my six children BENJAMIN (I. or J.) DuBOSE, BALSORA?, PETER, MARTHA P. and MARTILLIE and an infant unnamed, being my youngest child, to have and to hold the same to them and their heirs forever, in equal proportion, the said last mentioned personal estate to be held subject to the payment of my just debts, and I direct my executors hereinafter named, in the event of a sale of any slaves for the payment of debts, that NANCY, MARY, LOUISA and FANNY or either, at the election of my wife, MARY DuBOSE, shall be sold, and I further devise to my said seven children all the residue of my land not already herein devised, share and share alike, and I authorize my executors hereinafter named to exercise their discretion in keeping my said plantation up or selling the same as they think best for my children.

    And I hereby constitute and appoint my wife, MARY DuBOSE, my executrix and JAMES C. MOSS and ATHELSTON ANDREWS my execut[ors] to carry into effect the provisions of my said will. In witness whereof I have hereunto set my hand and affixed my seal at Mobile in said State this ninth day of January, 1841.

    Special Orphans Court, 1st March A.D. 1841, personally appeared in open court ISAAC DuBOSE, one of the subscribing witnesses to the foregoing will, who, being first duly sworn, deposeth and saith that he saw Peter DuBose, the testator, sign, seal and execute the same as and for his last will and testament and that the said Peter DuBose was, at the time of executing the same, of sound mind and disposing memory, and that he, this deponent, Reuben Saffold, Alfred Tarleton and R. G. Gordon signed the same as witnesses in presence of and at the request of said testator and in presence of each other on the day and year therein mentioned. /s/ISAAC DuBOSE
